Stewart, Roderick Dudley
Rod Stewart is a professionally registered Civil Engineer whose career spans more than 30 years.
Competent In These Forms of Contracts:
FIDIC, GCC, JBCC, NEC
Although he is a technically competent and experienced engineer, Rod has a passion for language and communication. He has a particular talent for elegantly and accurately drafting contractual correspondence and special contract terms, and in this regard has significant experience of all four of the standard form contracts widely used in South Africa and sub-Saharan Africa.
Rod’s aptitude for matters legal has been enhanced by his completing the Fellowship Admission course of the Association of Arbitrators of Southern Africa in 2017, and by complementing this qualification with the Specialisation in Construction Law in 2018 – also through the Association of Arbitrators.
Apart from being a practicing arbitrator, adjudicator, and amicable settlement facilitator, in 2016 Rod completed a five-day course in mediation presented by the London School of Mediation and so is able to practice in any of the four spheres of alternative dispute resolution typically used in the construction sector.
Subsequent to becoming a fellow of the Association of Arbitrators, Rod has completed one arbitration (GCC 2015), seven adjudications (4 x GCC 2105, 1 x NEC3, and 2 x JBCC), and has also facilitated two amicable settlement processes (GCC 2105) – with settlement being achieved by the parties in both instances.
Rod is also currently serving as a DAB member on four of the projects which form part of the multi-year upgrades to the N3 and N2 which are being undertaken by SANRAL in KwaZulu Natal.
Additionally, since 2020 he has served on the three-person DAB for one of the contracts forming part of the Bus Rapid Transport project being implemented by Msunduzi Municipality between Edendale and the City of Pietermaritzburg.
Completed 12 adjudications (8 GCC; 2 NEC; 2 JBCC); one arbitration (GCC); and four amicable settlements (3 GCC; 1 NEC)
Currently serve on 6 standing DABs: 5 of these are SANRAL contracts (FIDIC 1999), and the other is a City of Cape Town contract (GCC)
Rod’s fields of expertise are roads engineering, water engineering, and especially construction project and contract management. He has extensive experience of managing large bulk infrastructure construction projects in the mining, agriculture, and public infrastructure sectors in South Africa as well as numerous other sub-Saharan African countries, and is therefore well versed with the logistical, social, legal, and environmental challenges associated with undertaking construction projects in remote and under-serviced areas.
